Brick and Branch Real Estate Touring Agreement
Agreement Terms
This Touring Agreement (“Agreement”) is made between Buyer (“Buyer”) and Brick and Branch Real Estate (“Broker”) for real property located in the State of Georgia.
1. Purpose of Agreement
The purpose of this Agreement is to outline expectations and responsibilities during real estate property tours. This Agreement becomes effective upon Buyer’s electronic signature and applies for a period of seven (7) calendar days (“Touring Period”). During this Touring Period, Broker will provide property showings and Buyer agrees to the obligations described below.
2. Representation & Relationship
Buyer acknowledges that:
- Broker or Broker’s affiliated licensee is showing properties to assist Buyer in evaluating potential real estate.
- This Agreement does not create exclusive brokerage representation unless a separate Buyer Brokerage Agreement is executed.
- Broker is not a party to any purchase contract unless otherwise agreed in writing.
3. Buyer Responsibilities
Buyer agrees to:
- Arrive on time for tours and notify Broker of delays or cancellations.
- Refrain from entering properties without Broker’s permission.
- Respect property owners and all property rules.
- Avoid recording inside properties unless permitted by Broker and the property owner.
- Inform Broker promptly if Buyer has interest in submitting an offer on a toured property.
4. Broker Responsibilities
Broker agrees to:
- Coordinate and provide access to properties Buyer wishes to tour, when possible.
- Exercise reasonable care and skill in scheduling and showings.
- Provide general real estate guidance as allowed by Georgia law.
- Keep Buyer information confidential unless required by law.
5. Offer Submission & Compensation (Important)
Buyer understands and agrees that during the seven-day Touring Period:
- Broker will be the representative who prepares and submits any offer on any property shown to Buyer by Broker.
- If Buyer submits an offer on a toured property through another agent, directly to a seller, or directly to a builder, Buyer may become responsible for paying Broker’s compensation.
- Broker has the right to include a 3% buyer brokerage compensation in any offer prepared by Broker unless otherwise agreed in writing.
- Broker will request that the seller cover the buyer’s brokerage compensation at 3% whenever possible. Buyer understands that sellers or builders may offer different compensation amounts. If the seller does not offer the full 3%, Broker will review options with Buyer, which may include negotiating the difference or arranging alternative compensation terms.
- These provisions ensure Broker is compensated for time, expertise, scheduling, and professional services provided during the Touring Period.
6. Safety & Conduct
Buyer acknowledges risks inherent in touring properties and agrees to hold Broker harmless.
7. Confidentiality
Buyer agrees not to:
- Share property access codes or lockbox information.
- Share homeowner personal information learned during tours.
- Share photos or videos taken inside properties without permission.
8. No Agency Created by This Agreement
This Agreement does not create brokerage representation. A separate written Buyer Brokerage Agreement is required for agency representation.
9. Indemnification
Buyer agrees to indemnify and hold Broker harmless from claims or damages resulting from Buyer’s actions during property tours.
10. Term & Touring Period
The Touring Period lasts seven (7) calendar days from the time of electronic signature. The obligations regarding offers apply only to homes shown during this one-week period, even if an offer is submitted after the period ends.
11. Electronic Signature
Typing Buyer’s name below constitutes a legally binding electronic signature under Georgia law and the Federal ESIGN Act.
